Deed Restrictions: Provisions in a deed that set limitations on the use of real property, which may be in the form of covenants or conditions.
Grantee: The person receiving a grant of real property.
Grantor: The person conveying an interest in real property.
Merger: A method of terminating an encumbrance, such as an easement or deed restriction, when the properties involved come under single ownership.
Quitclaim Deed: A type of deed that conveys any interest the grantor may have in a property at the time of execution, but offers no warranties of clear title or ownership.
Covenants, Conditions, & Restrictions (CC&Rs): Declarations typically recorded by a developer to establish rules and limitations on the use of properties within a subdivision. Restrictions structured as “conditions” can lead to a loss of title if violated, while “covenants” usually result in penalties or legal action to compel compliance.
