When a property’s title is uncertain or subject to conflicting claims, a quiet title action establishes clear and undisputed ownership. This legal action aims to “perfect” the title, making it marketable and free from challenges. It is often used in situations involving alleged fraud, such as forged deeds, or other unclear title issues.
The other options are not considered quiet title actions:
Purchasing property through a dummy buyer is a deceptive practice, not a legal action to clarify title.
An action to remove a noisy tenant is typically addressed through eviction proceedings, also known as an unlawful detainer.
A foreclosure action is a process initiated by a lender to seize and sell a property when the borrower defaults on mortgage payments. While it affects title, its purpose is debt recovery, not clarifying existing title defects.
